Summary

The overall objective of our publications is to create the basis – in texts and in interpretations – for a new approach to Roman Law, not centered, as usual, on the Justinians’ s Corpus iuris civilis, but on the figures of the single roman jurists. This is a new approach to the understanding of the origin of the wester legal culture, essential in an epoch of changes as our present is.
The jurists were the chief protagonists of roman legal culture. But their acknowledged rule, which has never been called into doubt, did not prevent the complete eclipse of their profiles in the modern tradition. This was a paradoxical outcome, the effect of a distortion brought about by Justinian’s codification.
Since the Digesta were to appear for so many years as a Code and not as an anthology, over the centuries the constituent texts would not only be viewed outside of any historical perspective, but also in a light that compromised the perception of their very quality. They would be seen not for what they truly were – fragments of literary works that needed to be reintegrated into their original context – but rather as well-framed and carefully sorted articles of a unitary legislative apparatus.
What we propose is a change of perspective of great impact in considering this source, not only for the scholars in antiquity, but also for an educated audience, interested in law and history. A new historiographic model that will overturn current outlooks, making way for a different view which seems of a great interest today both for legal and historical studies.
We will carry out our goal through a reconstruction of the writings of the jurists ended down in the Digesta and in other late antiquity anthologies, proceeding by author and by work.
A collection, entitled Scriptores iuris Romani under the direction of PI, published by l\' \'Erma di Bretschneider\' (Rome), gathers the annotated editions. Each volume consists of five parts: Introduction dedicated to the jurist considered, and to his reconstructed work(s); testimonia on the life and the career of the jurist considered; Latin text (or Greek); Italian translation; Commentary.

Work performed

A) Publications

The edition of the volumes containing jurists works is progressive, and cover the entire period of the project (five years).
The publication of two books is imminent:

1) \'Giuristi romani e storiografia moderna. Dalla Palingenesia iuris civilis agli Scriptores iuris Romani\', edited by myself, which contains the transactions of our international Conference with the same title held in Rome on October 2016 (the publisher is \'Giappichelli Editore\' Torino). We just received the II proofs of this volume.

2) Quintus Mucius Scaevola. Opera, edited by J.-L- Ferrary, A. Schiavone, E. Stolfi, which is the first volume of our series \'Scriptores iuris Romani\', directed by myself. 
The volume - more the 500 pages - will be published by l\' \'Erma di Bretschneider\',Rome, which also publishes the entire series. We are waiting for the proofs. 

We scheduled a seminar in Paris (probably at Paris II)  to discuss the book as soon as it will appear. 


For the 2018 we scheduled at least the publication of:

1. Wise Men and Jurists from the XII Tables to the third century BC., edited by A. Bottiglieri, A. Manzo, V. Marotta, F. Nasti, E. Stolfi, G. Viarengo.
2. Paul, Commentaries on the Edict (Part One, Book 1-10), edited by. G. Luchetti, A. De Petris, S. Di Maria, F. Mattioli, I. Pontoriero.



B) International Conferences
We organized two major international conferences:

Final results

For the first time in the history of our studies we begin to dispose of commented editions of each work of each of the Roman jurists, starting from the founder of Roman legal science, Quintus Mucius Scaevola.
In the next period we plan to publish further commented editions concerning jurists of the 2nd and 3rd century AD. In particular Pomponius (Enchiridion), Ulpian (Institutiones and libri ad edictum), Marcianus (Institutiones), Macer (ad XX hereditatium, de iudicis publicis) and, moreover, a monograph on the legal culture of Aulus Gellius.
